General Terms of Sale of the PPR service
These Terms govern the online booking of the landing and parking service at the Garda Lake Airfield flight field. Where the customer is a consumer, the booking constitutes a distance contract pursuant to the Italian Consumer Code (Codice del Consumo) (D.Lgs. 206/2005).
1. Service provider
Garda Lake Airfield S.S.D. a R.L. — Registered office: Località Altura 1, 37017 Lazise (VR). Airfield: Località Colombaron 5, 37014 Castelnuovo del Garda (VR). 2. Subject matter
Landing and/or parking service for ultralight aircraft (VDS, MTOW up to 600 kg) at the flight field, in daytime VFR activity, subject to PPR (Prior Permission Required) authorisation and valid exclusively for the authorised dates.
3. Price
Landing fee 10 € + 10 € for each night of parking, amounts inclusive of taxes. The total is calculated on the basis of the selected dates and is shown before the order is confirmed.
4. Payment (authorisation and capture)
Payment is made on the website via Stripe with manual-capture authorisation: the amount is held on the card but not charged. The charge (capture) takes place only after approval by the Operator; in the event of refusal the hold is released at no cost. The authorisation has a limited technical duration (about 7 days): if it expires before approval, the order lapses and a new payment must be made.
5. Conclusion of the contract
The contract is concluded upon approval by the Operator. The PPR is effective only after payment and is valid only for the authorised dates. Following the order you will receive an email confirmation on a durable medium, with the booking summary and the full identity of the Operator.
6. Exclusion of the right of withdrawal
As this is a service relating to leisure activities with a specific date or period of performance, pursuant to art. 59, paragraph 1, lett. n) of the Italian Consumer Code (Codice del Consumo) the 14-day right of withdrawal does NOT apply. This information is also provided before payment.
7. Cancellations and refunds
In the event of suspension or closure of the field for safety reasons, weather conditions or measures of the competent Authorities, the Operator refunds the amounts paid for services not used. For cancellations by the pilot or no-show, contact the Operator: any refunds are assessed on a case-by-case basis.
8. Tax document
Upon payment, the tax document required by law is issued: the payment receipt issued by Stripe does not constitute an invoice. For pilots who are Italian citizens, the codice fiscale (Italian tax code) required for the relevant tax and accounting obligations is collected.
9. Liability
Parking and hangar storage do not constitute a deposit contract (art. 1766 c.c.): the areas are not guarded. The rules of the Airfield Regulations and of the Flight Activity Regulations apply in full, which the Pilot declares to know and accept.
10. Applicable law and jurisdiction
These Terms are governed by Italian law. For disputes with consumers, the court of the consumer's place of residence or domicile has mandatory, non-derogable jurisdiction (art. 66-bis of the Italian Consumer Code (Codice del Consumo)). For relations with non-consumer parties, the Court of Verona has exclusive jurisdiction.
